FOM Files Legal Complaint Against the Borough of Mendham Joint Land Use Board
Mendham Borough is facing a major development proposal to convert the Sisters of Christian Charity original Motherhouse and surrounding buildings into 150 rental apartments. To gain approval for this project the builder is requesting an overlay zone to the 110 acre Sisters property with an Inclusionary Lot of 20 acres for development. The proposed development includes 30 affordable housing units.
What the Complaint Is About
The legal complaint filed by local residents on April 17, 2026, does not seek to stop affordable housing. Instead, it challenges how the Borough approved this specific project and plan. The complaint argues that the Borough:
Skipped Proper Planning Steps: The town approved a housing plan and zoning changes before fully studying key components including: Financial impacts, Impacts on Volunteer Fire and EMS, Traffic and safety considerations, School capacity, Environmental constraints, Historic Significance of the Motherhouse, and Infrastructure limits (water, sewer, roads).
